A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY EXTENDING A LOCAL STATE OF EMERGENCY; TO CONTINUE PROVISIONS OF THE OFFICIAL CODE OF BUTTS COUNTY APPLICABLE TO A LOCAL STATE OF EMERGENCY; TO AUTHORIZE THE CHAIRMAN TO SIGN THE RESOLUTION ON BEHALF OF THE BOARD OF COMMISSIONERS; TO AUTHORIZE THE CLERK OF THE 125th SESSION OF BUTTS COUNTY TO ATTEST ALL DOCUMENTS; AND FOR OTHER RELATED AND LAWFUL PURPOSES.

WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia, and;

WHEREAS, the Butts County Board of Commissioners is the governing authority of the County, elected by the qualified electors of Butts County and vested with fiscal and legislative responsibilities necessary to the managing of the affairs of the County government, and;

WHEREAS, on January 12, 2023, a series of possible tornadoes touched down in Butts County causing considerable and widespread damage to property, roads and infrastructure, and;

WHEREAS, on January 12, Governor Brian Kemp declared a State of Emergency for all affected counties in Georgia, including Butts County; and,

WHEREAS, the County Governing Authority declared a local State of Emergency, valid through at least January 31, 2023, with provisions for extensions, freeing up the resources of the County to mitigate and respond to a variety of emergency and critical incidents in Butts County, and;

WHEREAS, the originally declared State of Emergency is determined to be ongoing at this time, with recovery operations still being managed on a daily basis by local, state and federal Emergency Management Agencies, and therefore needs to be continued, now, therefore be it:

RESOLVED, the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision, and it is, therefore, so:

ORDERED: That all resources of Butts County continue to be made available to assist in activities designed to recover from this emergency, and bring it to a successful conclusion, and it is further:

ORDERED: That the Butts County Office of Homeland Security shall maintain, in an active state, the Butts County Emergency Operations Plan in response to and recovery from this emergency, and that the following sections of the Butts County Code of Ordinances remain implemented and in force, to wit:

1). Article III: Registration of Building and Repair Services During a State of Emergency.

2). Sec. 22-1 (b: 1-5) Suspension of Portions of the Code of Ordinances and Other Formalities During a State of Emergency, including certain purchasing and procurement practices;

3). Sec. 22-3 Prohibition Against Overcharging for Goods, Materials, Services, and Housing

BE IT FURTHER RESOLVED that this Resolution and all provisions herein, shall be in full force and effect on February 1, 2023 or upon its signature by the Chairman of the Board of Commissioners, whichever is sooner, under his authority to sign resolutions declaring or extending a State of Emergency and that any and all resolutions or parts of resolutions, in conflict with this Resolution shall be, and to the extent of such conflict are, hereby repealed, and;

BE IT FURTHER RESOLVED that this extension of the Declaration of Local Emergency shall terminate at 11:59 PM on February 28, 2023 unless further extended by a supplemental resolution, and;

BE IT FINALLY RESOLVED that the Board authorizes the Chairman of the Board of Commissioners to sign this Resolution on their behalf and further authorizes the Clerk of the 125th Session to attest all signatures and to file this this Resolution in the Book of Resolutions, Volume 2, and as such, it is hereby:
