A RESOLUTION OF THE BOARD OF COMMISSIONERS TO AUTHORIZE THE CHAIRMAN AND COUNTY STAFF TO SIGN A QUITCLAIM DEED; AND FOR OTHER RELATED AND LAWFUL PURPOSES.

WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia, governed by the Butts County Board of Commissioners, who is the governing authority of the County, elected by the voters of Butts County and vested with fiscal and legislative responsibilities necessary to provide for the managing of the affairs of the County government, as well as the health, safety and welfare of the citizens of Butts County and the provision of public services to the residents thereof, and,

WHEREAS, the County desires to quitclaim a piece of property as grantor to Leon H. Poole as grantee, as outlined on the “Tax Redemption Quitclaim Deed attached as “Exhibit A”, said property described as follows:

All and only that parcel of land designated as Tax Parcel 0004A-076-000 lying and being in Land Lot 175 and 176 of the 3rd District of Butts County, Georgia, and being more particularly described as Lot (76) Seventy-Six containing approximately 2.442 acres of land and located within White Tail Hills Subdivision referred to by plan of survey recorded in Plat Book 12, Page 898 recorded on 9-2-95 in Butts County, Georgia Deed Records.
This being the same parcel conveyed to Leon H. Poole at a deed recorded in Deed Book 223, Page 99, and located on Coyote Trail, Jackson, GA. Said deed being recorded to correct Warranty Deed recorded in Deed Book 178, Pages 435-442 Butts County Clerk of Superior Court, Butts County, Georgia, also amended on March 10th, 1995, in Plat Book 178, Pages 436-442 of Butts County, Georgia. Above-described property is subject to that Declaration of Covenants, Conditions and Restrictions and the provisions of said Declaration are incorporated herein and made part hereof by this reference.
NOW, THEREFORE BE IT RESOLVED, that the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision; and it is further

RESOLVED BY THE BUTTS COUNTY BOARD OF COMMISSIONERS AS FOLLOWS:
1. Approve. The Butts County Board of Commissioners approves this resolution.
2. Authorization. The Board of Commissioners hereby authorizes the Chairman to sign all documents associated with carrying out the provisions of the Resolution through authorized staff.
3. Recordation. The Clerk of the 124th Session is hereby directed to record this Resolution, declaration, and certification and exhibits in the official Book of Resolutions, Volume 1, as referenced in the Minutes of the Board of Commissioners, and,

4. Severability. To the extent that any portion of this or any related Resolution is declared to be invalid, unenforceable, or nonbinding, that said invalidation shall not affect the remaining portions of this Resolution.

5. Repeal of Conflicting Provisions. All County resolutions are hereby repealed to the extent that they are in conflict with this Resolution.

6. Effective Date. This Resolution shall take effect immediately.
