A RESOLUTION OF THE BOARD OF COMMISIONERS OF BUTTS COUNTY TO REQUEST THAT THE LEGISLATIVE DELEGATION FILE LOCAL LEGISLATION TO RE-CONSTITUTE THE BOARD OF THE BUTTS COUNTY WATER AND SEWER AUTHORITY AND FOR OTHER PURPOSES.

WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia, charged with providing public services to local residents; and

WHEREAS, the Butts County Board of Commissioners is the governing authority of the County, elected by the qualified elections of Butts County and vested with fiscal and legislative responsibilities necessary to the managing of the affairs of the County government, as well as the health, safety, and welfare of the citizens of Butts County; and

WHEREAS, the Butts County Board of Commissioners desires to re-constitute the governing authority of the Butts County Water and Sewer Authority Board (the “Board”); and

WHEREAS, after consultations with representatives of certain cities, this proposal accommodates the interest of the County and those cities which receive and participate in water and sewer services from the Authority; and

WHEREAS, the Butts County Board of Commissioners in the exercise of their sound judgment and discretion, after giving thorough consideration to all implications involved, and keeping in mind the public interest and welfare of the citizens of the County, have determined that authorizing this Resolution would be advantageous to and would best benefit the citizens of the County; and

THEREFORE, IT IS NOW RESOLVED BY THE BUTTS COUNTY BOARD OF COMMISSIONERS AS FOLLOWS:
1. Request. The Butts County Board of Commissioners requests that the legislative delegation for Butts County file and seek enactment of legislation to reconstitute the Board of the Butts County Water and Sewer Authority (the “Board”), so that there shall be seven members of the Board consisting of five members appointed respectively by each Commissioner of the Butts County Board of Commissioners with each Board member to serve for a term commensurate of that of the appointed commissioner’s term of office along with one appointee from the City of Jackson and one appointed from the City of Jenkinsburg to be selected at the discretion of their respective Mayors and Councils and to serve a term of four years. The Chairman of the Board shall be a full voting member. A quorum shall consist of four members, and no action may be taken by the Board without a majority of the quorum and to provide for additional procedures regarding the appointment and removal of the members of the Board.
2. Authorization. The Board of Commissioners hereby authorizes the Chairman to execute and submit this Resolution to the legislative delegation of the County.
3. Recordation. The County Clerk is hereby directed to record this Resolution, declaration, and certification in the official Book of Resolutions of Butts County, Volume 1.

4. Severability. To the extent any portion of this Resolution is declared to be invalid, unenforceable, or nonbinding, that shall not affect the remaining portions of this Resolution.

5. Repeal of Conflicting Provisions. All County resolutions are hereby repealed to the extent they are inconsistent with this Resolution.

6. Effective Date. This Resolution shall take effect immediately.
