A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY LEGISLATING THE PROVISION OF CERTAIN FINANCIAL DOCUMENTS IN SUPPORT OF APPROPRIATIONS TO NON-BUTTS COUNTY GOVERNMENT ENTITIES; TO SET MINIMUM THRESHOLDS FOR PROVISION OF DOCUMENTS; TO AUTHORIZE THE CHAIRMAN TO SIGN THE RESOLUTION; TO AUTHORIZE THE CLERK OF BUTTS COUNTY TO ATTEST THE RESOLUTION; AND FOR OTHER RELATED AND LAWFUL PURPOSES.

WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia; and

WHEREAS, the Butts County Board of Commissioners, hereinafter referred to as “The Commission”, is the elected governing body, charged with managing the fiscal affairs of the County and as such, is empowered by law to cause a budget to be promulgated for appropriating sums of money for the staffing and operation of various internal and external agencies which provide government services to the Citizens of Butts County, and;

WHEREAS, the Commission has, in the past, provided that budgetary appropriations be awarded to external agencies who provide government services in lieu of the County directly providing said services, the use of said appropriations being in support of that agency in addition to other funds which the agency may have access to, and;

WHEREAS, the Commission feels that a greater degree of accountability is called for in the annual appropriations budget so that the County and its Citizens can be assured that public funding is being provided in a manner that is consistent with Georgia law and Generally Accepted Accounting Practices, now therefore be it:

RESOLVED, that the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision.

BE IT FURTHER RESOLVED that the Commission, as the legislative body of the County government shall, from the date of this instrument, require that upon submission of the required annual requests for any budgetary appropriations of $10,000.00 or more from any governmental or quasigovernmental agency engaged in providing government services or benefits to the Citizens of Butts County that said agency shall also be required to submit with its request for appropriation a certified audit report covering the most recent completed fiscal year of said agency and;

BE IT FURTHER RESOLVED that any community agency which requests and received budgetary appropriations from the County for the provision of services to or for the County in the amount of $10,000.00 or greater shall be required to submit a board-approved financial statement that clearly shows the use of said funds and for what purpose, and;

BE IT FURTHER RESOLVED that any agency which fits the aforementioned criteria as outlined within this instrument who does not submit a required audited financial report or financial statement with their annual budgetary appropriation request shall not be eligible to receive an appropriation in the forthcoming budget year, and;

BE IT FURTHER RESOLVED that the provisions of this Resolution only apply to agencies that are not directly under the fiscal control of the Butts County Government, and shall not include any internal agencies which are already provided for in the Comprehensive Annual Financial Report, and;

BE IT FURTHER RESOLVED that the effective date of this resolution shall be July 1, 2019 and that all changes resulting from this Resolution shall be in effect from that date forward, and that any and all resolutions or parts of resolutions in conflict with this Resolution shall be, and they, to the extent of such conflict are, hereby repealed, and;

BE IT RESOLVED that it is the express intention of the Board of Commissioners that each independent provision of this Resolution should be adopted, and that the Board would have adopted each such independent provision even if the others had not been adopted; therefore, in the event that a court of competent jurisdiction finds any of the aforementioned to be unlawful, invalid or unenforceable, that it is the intent of the Board of Commissioners that the offending provision be severed, and that all lawful provisions remain in force, and;

BE IT FINALLY RESOLVED that the Board authorizes the Chairman of the Board of Commissioners to sign this Resolution on their behalf; authorizes the Clerk of Butts County to attest all signatures and spread this resolution upon the minutes of the Board of Commissioners; and authorizes the Chief Financial Officer to communicate this requirement to all affected agencies immediately.
