ORDINANCE NO. CR202332
BUTTS COUNTY, GEORGIA
AN ORDINANCE TO AMEND THE OFFICIAL CODE OF BUTTS COUNTY, GEORGIA BY ADDING SECTION 14-3 OF ARTICLE I OF CHAPTER 14 REGARDING DOCUMENTS REQUIRED FOR A BUILDING PERMIT APPLICATION AND FOR OTHER PURPOSES.
WHEREAS, the Butts County Board of Commissioners republished its Official Code in 2012; and
WHEREAS, the Board of Commissioners desires to add Section 14-3 to Article I of Chapter 14 of Part II of its Official Code; and
WHEREAS, the Board of Commissioners has complied with all local and state laws to create this ordinance; and
WHEREAS, the Board of Commissioners conducted and held a duly noticed public hearing on June 26, 2023, to so amend the Official Code of Butts County, Georgia.
NOW, THEREFORE, THE BOARD OF COMMISSIONERS OF BUTTS COUNTY HEREBY ORDAINS:
SECTION ONE: Part II, Chapter 14, Article I of the Official Code of Butts County, Georgia is hereby amended by adding a new Section 14-3, which is currently reserved to read as follows:
In addition to the application for a building permit, the following documents shall be required for each type of development:
A. New Single-Family Residence
1. Warranty deed and recorded plat;
2. Homeowner’s affidavit or contractor’s business and State contractor’s licenses;
3. Authorized Permit Agent Form (if applicable);
4. Sub-contractor affidavits for each trade;
5. Proof of all County taxes paid;
6. Septic approval letter;
7. Water tap and/or sewer tap fees paid;
8. Driveway permit;
9. House location plan with dimensions to property lines; and
10. Building plans including footings, elevations, floor plan, and M.E.P.s.
B. New Commercial
1. Warranty deed and recorded plat;
2. Contractor’s business and State contractor’s licenses;
3. Authorized Permit Agent Form (if applicable);
4. Proof of property all County taxes paid;
5. Septic approval letter;
6. Water tap and/or sewer tap fees paid; and
7. Building plans.
C. Demolition
1. Warranty deed and recorded plat;
2. Homeowner’s Affidavit or contractor’s business and State contractor’s licenses;
3. Authorized Permit Agent Form (if applicable);
4. Proof of all County taxes paid;
5. Site plan denoting which building(s) are to be demolished;
6. Asbestos survey; and
7. Rodent control plan.
D. Manufactured Homes
1. Warranty deed and recorded plat;
2. Bill of sale if new, copy of title and paid tax receipt, if used;
3. Installation instructions, if new, or floor plan, if used;
4. Proof of all County taxes paid;
5. House location plan with dimensions to property lines;
6. Septic approval letter;
7. Driveway permit; and
8. Roof pitch certification letter (4:12 or greater).
E. Residential Alterations (Interior/Exterior Alterations)
1. Warranty deed and recorded plat;
2. Homeowner’s affidavit or contractor’s business and State contractor’s licenses;
3. Authorized Permit Agent Form (if applicable);
4. Septic Approval letter;
5. Proof of all County taxes paid;
6. Floor plan if changing; and
7. Detailed description of the scope of work.
F. Residential Addition
1. Warranty deed and recorded plat;
2. Homeowner’s affidavit or contractor’s business and State contractor’s licenses;
3. Authorized Permit Agent Form (if applicable);
4. Proof of all County taxes paid;
5. House location plan with dimensions to property lines; and
6. Building plans including footings, elevations, floor plan, and M.E.Ps.
G. Swimming Pool
1. Warranty deed and recorded plat;
2. Homeowner’s affidavit or contractor’s business and State contractor’s licenses;
3. Authorized Permit Agent Form (if applicable);
4. Proof of all County taxes paid;
5. Septic approval letter;
6. House location plan with dimensions to property lines; and
7. Pool layout dimensions and construction type.
H. Accessory Structure
1. Warranty deed and recorded plat;
2. Homeowner’s affidavit or contractor’s business and State contractor’s licenses;
3. Authorized Permit Agent Form (if applicable);
4. Proof of all County taxes paid;
5. Septic approval letter;
6. House location plan with dimensions to property lines and existing structures; and
7. Building plans including footings, elevations, floor plan, M.E.Ps.
I. Solar Panels
1. Warranty deed and recorded plat;
2. Homeowner’s affidavit or contractor’s business and State contractor’s licenses;
3. Authorized Permit Agent Form (if applicable);
4. Proof of all County taxes paid;
5. Building plans;
6. Make sure that “Work Authorized” is listed as “Building” and “Electrical,” and that the
“Type of Project” is listed as “Solar Panels” and not “Electrical”; and
7. If ground-mounted:
1. Site plan showing dimensions to property lines; and
2. Septic approval letter.
J. Stand-Alone Trade Permits
1. Warranty deed and recorded plat;
2. Homeowner’s affidavit or contractor’s business and State contractor’s licenses;
3. Authorized Permit Agent Form (if applicable);
4. Proof of all County taxes paid; and
5. Detailed description of the scope of work.
K. Other documents may be required at the determination of the County Engineer, Director of Planning & Development, Building Official, Health Department, Fire Marshal or other reviewing entity.
SECTION TWO:
A. Recordation: The County Clerk is hereby directed to record this Ordinance in the official Book of Resolutions, Volume 2 and reference in the minutes of the County and to publish this Ordinance in accordance with law and with the County’s on-line code publisher.
B. Severability Clause: It is the express intention of the Board of Commissioners that each independent provision of this amendment should be adopted, and the Board of Commissioners would have adopted each such independent provision even if the others had not been adopted. Therefore, in the event that a court of competent jurisdiction finds any provision of this amendment or the Official Code of Butts County, Georgia to be unlawful, invalid, or unenforceable, it is the intent of the Board of Commissioners that the offending provision be severed, and all lawful provisions remain in force.
C. Penalty Clause: Unless another penalty is expressly provided, every person convicted of a violation of this Ordinance shall be punished by a fine not to exceed $1,000.00, imprisonment not to exceed 180 days, or both such fine and imprisonment.
D. General Repealer: Any Ordinance not expressly addressed by this Ordinance that is inconsistent with the provisions herein is expressly repealed to the extent that it conflicts with the provisions of this amending Ordinance.
E. Effective Date: The public welfare demanding, this Ordinance shall be effective immediately after its adoption.
