Minutes of the Board of Commissioners for December 12, 2022

The Butts County Board of Commissioners held their December workshop and meeting on the 12th day of the month. The workshop convened at 5:30 PM and covered the following topics:
1). Approval of the CY2023 Calendar of Holidays (13) and Regular Meetings
2). End of Year Appointments to Authorities, Boards and Committees
3). The 2023 Budget Book and FY2022 Budget Amendments
4). New Employee Vesting and New Retirement Program for Commissioners
5). Renewal of Probation Services Agreement with Southeast Corrections LLC for Probate Court

All of the above items were carried forward onto the Consent Agenda for the 6:00 PM meeting. Following this, the board members recessed outside to look at new fire engines purchased by the county.

Regular Meeting 6:00 PM
Chairman Brown called the meeting to order at 6:00 pm. Also in attendance was Commissioners Russ Crumbley, Keith Douglas, Robert Henderson, and Ken Rivers.

Item 2022-12-181 Adoption of the Docket
Mr. Brewer presented the docket and requested approval. Mr. Rivers moved to approve the docket, seconded by Mr. Crumbley with unanimous consent.

Item 2022-12-182 Approval of Minutes
Mr. Brewer presented the minutes and requested approval. Mr. Rivers moved to approve the docket, seconded by Mr. Crumbley with unanimous consent.

Item 2022-12-183 Special Presentations
The Board recognized Election Workers for their hard work during the 2022 Election Cycle. They also recognized several members of the Fire Department for earning lifesaving awards.

Item 2022-12-184 Proclamation in Remembrance of Jacqueline Cavender
Mr. Brewer presented a proclamation to the Board of Commissioners in remembrance of the late Jacqueline Cavender, former county clerk, who passed away in July 2022. Mr. Rivers motion to approve the proclamation, seconded by Mr. Crumbley and passed with unanimous consent. Mr. Crumbley gave personal remarks about Mrs. Cavender and her work with the county over the years.

Item 2022-12-185 Consent Agenda
Mr. Rivers moved to approve the Consent Agenda, seconded by Mr. Crumbley with unanimous consent. Items:

A. Resolution CR202258 Adopting the CY2023 Holiday and Meeting Calendar
B. Resolution CR202259 Fixing End of Year Appointments
C. Resolution CR202260 Approving FY2022 Final Budget Amendments
D. Resolution CR202261 Approving Employee and Commissioner Retirement Plan adjustments.
E. Resolution CR202262 Renewing Contract for Probation Services with Southeast Corrections LLC

Item 2022-12-186 Public Hearing on Special Use Case 11-01-2022-SU)
A public hearing was called as advertised. Mrs. Donna Popp, applicant, spoke in favor of the Special Use. No one spoke against and the public hearing was closed. Mr. Crumbley moved to approve the Special Use with all recommendations made by the Planning Commission to be applied and upheld, seconded by Mr. Rivers and approved unanimously.
Item 2022-12-187 Reports
Ms. Blissit gave the financial report. With 42% of the budget year completed, the County has received 59% of anticipated revenues and has expended 39%, which is excellent.

Mr. Brewer gave the operations report on departments, noting that several departments had seen decreased numbers in service delivery as the County enters the slower months of the year.

Mr. Johnson gave the County Manager’s Report on several outstanding activities by departments centered around the holiday season and community outreach.

Item 2022-12-188 Executive Session for Litigation and Personnel and Report by Attorney
Mr. Rivers moved to enter Executive Session, seconded by Mr. Douglas with unanimous consent. Later, the same moved to return from session with unanimous consent.

Mr. Welch reported that he had updated the board on litigation concerning the rock quarry as well as an injunction filed by the county on a personal care home operating without a license and without proper zoning. He also notified the public that the board had received the resignation of Mr. Charlie Brodie from the board of assessors. Mr. Douglas then moved to accept the resignation of Mr. Brodie, second by Mr. Henderson, and approved 4-1 with Mr. Rivers in dissent.

Item 2022-12-189 Adjournment of the 124th Session and the 2021-2022 Term.
Mr. Douglas moved to adjourn sine die the 124th session of the Board of Commissioners, seconded by Mr. Henderson, and approved unanimously. This concludes the 2021-2022 Term. The 125th Session and the 2023-2023 Term will be convened on January 9, 2023.
