RESOLUTION NO. 2022-32

A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY WAIVING IMPACT FEES ON A CHURCH CONSTRUCTION PROJECT AND FOR OTHER RELATED PURPOSES.

WHEREAS, Crossover Ministries has filed a request to be exempted from development impact fees due in the amount of $17,000.00; and

WHEREAS, Section 7.01.12(a)(3) of the Unified Development Ordinance provides an exemption for the replacement of a building or structure with a new building or structure of the same size and use; and

WHEREAS, the Board of Commissioners wishes to affirm the grant of said exemption provided that the building in which the church is located will be demolished as part of a development of the new church and, as a result, no impact fee would be required unless the existing building from which the church is relocating has not been demolished at the time of the issuance of the final Certificate of Occupancy for the new church building; at which time, if the old church building has not been demolished, then the impact fees will be due and owing, prior to the issuance of a final Certificate of Occupancy for the new church; and

WHEREAS, such exemption shall not be construed to provide exemptions from other required fees for services provided by the County but shall be applied only to the exemption of Development Impact Fees, now, therefore be it:

RESOLVED, the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision; and it is further

RESOLVED, that the Commission hereby does approve the decision of the County Manager to exempt the aforementioned fees as described above and as conditioned above, in the amount of $17,000.00, and does authorize the Chairman to sign this Resolution on behalf of the Commission and to cause said Resolution to be recorded in the Book of Resolutions, Volume 1 as reflected in the minutes.
