A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY TO AUTHORIZE THE DISSEMINATION OF PREMIUM PAY TO CERTAIN DESIGNATED COUNTY EMPLOYEES; TO IDENTIFY THE SOURCE OF FUNDING FOR PREMIUM PAY; TO DEFINE WHO SHALL BE CONSIDERED ELIGIBLE RECIPIENTS OF PREMIUM PAY; TO SET FORTH THE DOLLAR AMOUNTS THAT SHALL BE APPORTIONED TO ELIGIBLE EMPLOYEES OF THE COUNTY; TO AUTHORIZE THE CHAIRMAN TO SIGN THE RESOLUTION AND ALL REQUIRED DOCUMENTS IN PURSUIT OF THE OBJECTIVES OF THIS RESOLUTION ON BEHALF OF THE BOARD OF COMMISSIONERS; TO AUTHORIZE THE CLERK OF THE 123RD SESSION TO ATTEST ALL DOCUMENTS; AND FOR OTHER RELATED AND LAWFUL PURPOSES.

WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia and governed by the Butts County Board of Commissioners, and;

WHEREAS, the Butts County Board of Commissioners, the governing body of the county is charged with approving expenditures of an extraordinary nature in accordance with their lawful duties, and;

WHEREAS, on March 11, 2021, the President of the United States of America signed into law the “American Rescue Plan Act of 2021”, also known as House Resolution 1319, an Act approved by the Congress of the United States, and which authorized the Treasury of the United States to disburse certain funds to local governments, including Butts County, which could be used for specific and defined purposes, and;

WHEREAS, in accordance with the American Rescue Plan Act of 2021, the Butts County Board of Commissioners wishes to exercise its right to extend and disseminate “Premium Pay” to certain County employees in various amounts tied to specific criteria, as authorized by the Act, to assist employees who may have been impacted financially by the ongoing COVID-19 Pandemic, and;

WHEREAS, the Butts County Board of Commissioners wishes to appropriate sums to individual employees based on income, classification and related criteria, now, therefore be it:

RESOLVED, that the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision.

BE IT FURTHER RESOLVED the Commission does hereby authorize the expenditure of funds received under the American Rescue Plan Act of 2021 for the purpose of “Premium Pay” as defined in said Act, and does hereby establish the following criteria for the receival of said funds for all eligible employees who were employed with the County prior to August 31, 2021, and who are currently employed as of the date of the release of these funds, as defined herewith:

– To all full-time employees of Butts County with a base salary under $50,000.00 (Fifty-Thousand Dollars) per annum, the Board authorizes the sum of $1,500.00 (One-Thousand, Five-Hundred Dollars) and;

– To all full-time employees of Butts County with a base salary of $50,000.00 (Fifty-Thousand Dollars) per annum or greater, the Board authorizes the sum of $1,000.00 (One-Thousand Dollars) and;

– To all active, regularly scheduled weekly Part Time Employees of Butts County the Board authorizes the sum of $500.00 (Five-Hundred Dollars) and;

– To all Full Time Public Safety Employees of Butts County, defined herein as those working for the Butts County Sheriff’s Office, Butts County Coroner’s Office, Emergency Services Department and E-911 Department, an additional sum of $500.00 (Five-Hundred Dollars) is authorized, regardless of base salary, and;

BE IT FURTHER RESOLVED that all persons serving as Elected Officials, appointed members of Authorities, Boards and Committees, Non-Regular Part Time Employees, Temporary and Seasonal Employees are specifically excluded from the provisions of this Resolution and are deemed ineligible to receive Premium Pay, and;

BE IT FURTHER RESOLVED that the Board through this Resolution specifically authorizes the expenditure of funds covered under the auspices of the Act and directs the County Manager to cause staff to carry out the provisions of this Resolution with the effect that all eligible employees shall receive this additional pay appropriation included with their compensation pay date of November 19, 2021, minus any required federal or state taxes or other required withholdings that may be withheld, and;

BE IT FURTHER RESOLVED that the Board directs the Chief Financial Officer to keep a separate and permanent accounting of all disbursements to employees made under the provisions of this Resolution and the American Rescue Plan Act in case of future audit or need for reference, and;

BE IT FURTHER RESOLVED that the effective date of this resolution shall be October 25, 2021 and shall be valid from that date forward, and that any and all resolutions or parts of resolutions in conflict with this Resolution shall be, and they, to the extent of such conflict are, hereby repealed, and;

BE IT FINALLY RESOLVED that the Board authorizes the Chairman of the Board of Commissioners to sign this Resolution on their behalf and authorizes the Clerk of the 123rd Session to attest all signatures and to file said Resolution in the Book of Resolutions, Volume 1, and it is, hereby:
