A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY AUTHORIZING CERTAIN EMERGENCY EXPENDITURES OF FUNDS; TO AUTHORIZE THE CHAIRMAN TO SIGN THE RESOLUTION ON BEHALF OF THE BOARD; TO AUTHORIZE THE CLERK OF THE 123RD SESSION TO ATTEST ALL DOCUMENTS; AND FOR OTHER RELATED AND LAWFUL PURPOSES.
WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia and governed by the Butts County Board of Commissioners, and;
WHEREAS, the Butts County Board of Commissioners, as the governing body of the County charged with managing the fiscal affairs of the government, approves and adopts a Fiscal Purchasing Policy that sets specific monetary limits on what may be expended in the course of normal business and which also sets caps on the amounts that can be expended by staff without approval by the Board of Commissioners, and;
WHEREAS, certain expenditures which exceed the established cap as outlined in the Purchasing Policy may be expended, upon the approval of the County Manager, for emergency purposes, subject to ratification and approval by the Board of Commissioners at the soonest available meeting of the Members following said expenditure, and;
WHEREAS, it has now come before this honorable Board of Commissioners the following emergency expenditures which have been authorized by the Administration and which now require the approval of the Members of the Butts County Board of Commissioners, as follows:
• Approval to expend the sum of $161,558.28 to upgrade a critical component of the E-911 receiver switching system that is obsolete and which, if it fails, will render the County E-911 radio communication component inoperable, potentially placing lives and property in danger, and which will be expended from Special Purpose Local Option Sales Tax funds allocated to Public Safety, and;
• Approval to expend the sum of $55,579.52 to purchase a John Deere 5090E Cab Tractor used for mowing County right-of-ways, said tractor to replace one that has been rendered inoperable by irreparable engine component damage and which, if not immediately replaced, will result in a 50% reduction in the County’s ability to mow and maintain said right-of-ways, contributing to potentially dangerous situations where line of sight visibility for motorists could be impaired, resulting in collisions and potentially in loss of life, and which shall be expended from the General Fund and Impact Fees allocated to Public Works, and;
• Approval to expend $57,394.24 from the General Fund to replace an inoperable camera video system utilized in a portion of the jail which is used to monitor inmates and conditions within the jail and which, if not replaced with an operable camera system, does not allow utilization of that section of the jail, increasing potential liability against the County and its employees and which does not meet conditions required of an operable jail pod, and;
WHEREAS, the County Manager has deemed all of the aforementioned expenditures to be classified as an emergency expenditure in accordance with the Purchasing Policy of Butts County, now, therefore be it:
RESOLVED, that the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision, and;
BE IT FURTHER RESOLVED the Commission, through this Resolution, does hereby ratify and approve the decisions of the County Manager and Staff to expend said funds in the manner in which they have been specified and from specific funding sources, and;
BE IT FURTHER RESOLVED that this Resolution and all provisions herein, shall be in full force and effect upon its adoption by the Butts County Board of Commissioners and that any and all resolutions or parts of resolutions in conflict with this Resolution shall be, and they are, to the extent of such conflict, hereby repealed, and;
BE IT FURTHER RESOLVED that the Board authorizes the Chairman of the Board of Commissioners to sign this Resolution on their behalf and does authorize the Clerk of the 123rd Session to attest all signatures and place in the Book of Resolutions, Volume A, and;
BE IT FINALLY RESOLVED that the Board authorizes the Chief Financial Officer of Butts County to oversee this process.
