A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY ENACTING A RESTRICTIVE SPENDING MORATORIUM; TO AUTHORIZE THE CHIEF FINANCIAL OFFICER TO DIRECT THE MORATORIUM; TO AUTHORIZE THE COUNTY ADMINISTRATOR AND STAFF TO OVERSEE ALL PROCESSES; TO AUTHORIZE THE CHAIRMAN TO SIGN THE RESOLUTION; TO AUTHORIZE THE CLERK OF BUTTS COUNTY TO ATTEST ALL DOCUMENTS; TO AUTHORIZE THE TRANSMITTAL OF THE MORATORIUM TO ALL APPROPRIATED ENTITIES; AND FOR OTHER RELATED AND LAWFUL PURPOSES.

WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia; and

WHEREAS, the Butts County Board of Commissioners, the governing body of the county charged with maintaining the surety and financial stability of the County, as well as managing the affairs of the governing body, has determined that it is in the best interest of the County to enact a restrictive spending moratorium due to instability in cash flow and the desire to preserve unrestricted reserve funds, and;

WHEREAS, the Chief Financial Officer has the fiduciary responsibility to monitor, forecast and apply reasonable restrictive spending measures as deemed necessary based on actual and predicted revenues and anticipated outflows, and;

WHEREAS, the County Administrator and the Board of Commissioners are in agreement that a restrictive spending moratorium is advisable and prudent during this time and until such time as it is deemed to no longer be needed, now, therefore, be it:

RESOLVED, the Commission hereby declares and enacts a “Restrictive Spending Moratorium” applicable to all County agencies and entities for which the Board of Commissioners appropriates funding, hereinafter referred to as “The Moratorium”, and;

BE IT FURTHER RESOLVED the Commission, through this Resolution, does hereby authorize the Chief Financial Officer to administrate the moratorium, subject to the oversight and supervision of the County Administrator and to enforce the provisions herein to the extent allowable under the Code of Butts County and the laws of the State of Georgia, and;

BE IT FURTHER RESOLVED that said moratorium shall apply to all discretionary spending in all agencies under the purview and control of the Board of Commissioners, with full restrictions placed on discretionary purchasing, and;

BE IT FURTHER RESOLVED that all contractual services in effect at the time of this moratorium shall be honored, with the provision that no contract will be renewed without a full review by the financial staff and that any self-renewing contracts shall be placed under review prior to the date said contract is scheduled to automatically renew to determine whether said contract is necessary and critical to county operations, and;

BE IT FURTHER RESOLVED that every effort will be made to prioritize life-safety public policies and services first and to allocate financial resources towards critical functions and citizen safety before non-critical and quality of life initiatives, to ensure that those functions which are essential to the life, health and safety of our citizens receive the highest consideration for funding, and;

BE IT FURTHER RESOLVED that the governing authority shall have the right and may exercise, as needed, the powers to restrict or suspend nonessential services should it be determined to be a matter of financial necessity to do so, and;

BE IT FURTHER RESOLVED that through this Resolution, all Directors, Managers, Supervisors and other employees under the purview of the Board of Commissioners are hereby directed to comply with all of the resolutions contained herein, as well as any other restrictive spending measures which may prove necessary and which are promulgated by the Administration with concurrence by the Board of Commissioners, the failure of which to comply shall carry disciplinary consequences up to and possibly including termination, and;

BE IT FURTHER RESOLVED that this Resolution shall be in full force and effect immediately upon its adoption by the Butts County Board of Commissioners and shall continue until it is lifted by action of the Board and that any and all resolutions or parts of resolutions in conflict with this Resolution shall be, and they, to the extent of such conflict, hereby repealed, and;

BE IT FURTHER RESOLVED that the Board authorizes the Chairman of the Board of Commissioners to sign this Resolution on their behalf and to authorize the Clerk of Butts County to attest all signatures and spread this resolution upon the minutes of the Board of Commissioners
