A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY TO CREATE A HEALTH INSURANCE RETIREMENT OPTION; TO AUTHORIZE THE COUNTY ADMINISTRATOR AND STAFF TO OVERSEE ALL PROCESSES; TO AUTHORIZE THE CHAIRMAN TO SIGN THE RESOLUTION; TO AUTHORIZE THE CLERK OF BUTTS COUNTY TO ATTEST ALL DOCUMENTS; TO AUTHORIZE THE HUMAN RESOURCES GENERALIST TO COMMUNICATE THIS RESOLUTION TO THE DEFINED BENEFITS PENSION ADMINISTRATOR; AND FOR OTHER RELATED AND LAWFUL PURPOSES.
WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia; and
WHEREAS, the Butts County Board of Commissioners, the governing body of the county charged with managing the affairs of the County has determined that it is in the best interest of the County to create a “Health Insurance Retirement Option” for the benefit of employees who meet certain criteria and wish to exercise their defined benefits retirement option under the conditions defined hereunto, and;
WHEREAS, it has been determined that to offer such a program would be mutually beneficial to both the County and the eligible Employees, including creating opportunity for professional growth and career development for other employees, now therefore be it;
RESOLVED, the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision.
BE IT FURTHER RESOLVED the Commission, through this Resolution, does hereby create a “Health Insurance Retirement Option” and opens said retirement option to all employees who meet certain conditions as of January 1, 2019 and who voluntarily, in writing, exercise their option to avail themselves of this program subsequent to that date, and;
BE IT FURTHER RESOLVED that this retirement option shall be afforded to any full time employee currently enrolled in the Defined Benefits Plan of Butts County, who is determined to be, based upon the plan they are enrolled in, eligible at the time of election to retire under the GEBCorp retirement plan, including provisions for minimum age as defined by the plan; whose combined age and years of service equals 75; and who are fully vested in the pension program, and;
BE IT FURTHER RESOLVED that any employee who is determined to be eligible for this Health Insurance Retirement Option and who chooses to exercise it shall be afforded the right to keep and retain their County provided health insurance, at the level of coverage in which they had elected to take it during the enrollment period of the calendar year most immediately preceding their elected date of retirement, and who have been enrolled in the health insurance plan for at least three years prior to the date of retirement, up until said employee shall become eligible to receive Medicare, after which all County provided health insurance benefits shall be discontinued, including, if applicable, any dependents covered under the health insurance policy in place at the time, and;
BE IT FURTHER RESOLVED that if any employee is covered under this program, that they shall be afforded only the right to drop either dependent coverage or their own personal coverage plus dependent coverage; that they will not be afforded the right to add coverage and that dependent coverage shall not be provided once the employee, as primary beneficiary of the policy, becomes Medicare eligible, and that the retired employee shall be required to pay their portion of all premiums at those levels offered to working full time employees through a payroll deduction of their retirement benefit check, said funds to be remitted back to the County, and;
BE IT FURTHER RESOLVED that the Board of Commissioners reserves the unequivocal right to terminate this program with 90 days notice, after which no employee not already enrolled in the program shall be eligible for this Health Insurance Retirement Benefit going forward from the date of program termination, and;
BE IT FURTHER RESOLVED that the Board authorizes the County Administrator or their designee to oversee all processes of this Resolution, under the advice and counsel of the County Attorney at such time as the process is initiated, and;
BE IT FURTHER RESOLVED that this Resolution shall be in full force and effect immediately upon its adoption by the Butts County Board of Commissioners and that any and all resolutions or parts of resolutions in conflict with this Resolution shall be, and they, to the extent of such conflict, hereby repealed, and;
BE IT FINALLY RESOLVED that the Board authorizes the Chairman of the Board of Commissioners to sign this Resolution on their behalf and to authorize the Clerk of Butts County to attest all signatures and spread this resolution upon the minutes of the Board of Commissioners and authorizes the Human Resources Generalist to communicate this Resolution and all related materials to the Benefits Provider.
