A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY TO APPOINT A SPECIAL PROJECT DIRECTOR FOR MANAGEMENT OF A SPLOST PROJECT; TO PROVIDE A MECHANISM FOR COMPENSATION AND BENEFITS; TO DEFINE TERMS OF COMPENSATION AND DURATION OF APPOINTMENT; TO SPECIFY AN EXIT CLAUSE; TO CREATE A FULL TIME POSITION FOR AN ADMINISTRATIVE CLERK; TO AUTHORIZE THE CHAIRMAN OF THE BOARD OF COMMISSIONERS TO SIGN THE RESOLUTION ON BEHALF OF THE BOARD; TO AUTHORIZE THE CLERK OF THE 123RD SESSION TO ATTEST ALL DOCUMENTS AND CAUSE TO BE IMPLEMENTED THE EFFECTS OF THIS RESOLUTION; AND FOR ALL OTHER RELATED AND LAWFUL PURPOSES.

WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia and governed by the Butts County Board of Commissioners, and;

WHEREAS, the Butts County Board of Commissioners, the governing body of the county is charged with executing contracts for goods, services, professional consulting services and related needs of the County, and;

WHEREAS, it is the desire of the Members to appoint a Special Project Director to oversee certain aspects of the County Administrative Office Building Expansion Project, hereinafter referred to as “Project” and which is a SPLOST project currently in process and which is anticipated to be completed prior to the end of Fiscal Year 2021, whose sole focus shall be ensuring that the project is substantially complete or brought to a point where, in the determination of the County Manager, the project can handed off to other staff of the County, and;

WHEREAS, it is the desire of the Members to appoint Steven H. Layson to serve in the aforementioned capacity for the purposes of carrying the aforementioned intent of this Resolution and to provide certain compensatory allowances as payment for services rendered, and;

WHEREAS, it has been determined that due to exigencies created by an ongoing pandemic situation as well shortages that occasionally occur from time to time in other department, there is a need to have a floating position that can assist in multiple departments within the County Administrative Office Building and it has been determined by the Administration that existing funds within the allocated budget already exist that can be used to fill this need, now, therefore be it:

RESOLVED, that the Members hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision, and;

BE IT FURTHER RESOLVED the Board of Commissioners does hereby appoint Steven H. Layson to serve as Special Project Director for the project referred to as “County Administrative Office Building Expansion” effective retroactively to January 1, 2021, for a period of no longer than three (3) months, with a maximum date of March 31, 2021 as determined by the County Manager with concurrence of the Board of Commissioners, and shall assign compensation in the following manner:

A). Payment of a maximum salary of $18,957.00 or $3,159.50 per pay period.

B). The Granting of prorated leave for the maximum of three months, which based on the last six months of the employment contract ending December 31, 2020 would be equivalent to 200 hours/$7,898.75 and which would be paid into the existing 401A plan that was set up for the appointee during his previous employment with Butts County upon conclusion, and;

C). Provision of a vehicle for transportation and fuel.

D). In the event that either the appointee or the County determines that the services of the appointee, for the purposes described herein, are no longer needed or required, then everything will be prorated to ensure all allowable compensation accurately represents the time the appointee was effective in said appointment;

BE IT FURTHER RESOLVED that for the duration of this appointment, the appointee shall report directly to the County Manager or their designee and shall routinely and regularly advise the County Manager of any issues, concerns, progress or related information pertaining to the Project and shall submit all pay advice, invoices and related materials to said County Manager for approval, and;

BE IT FURTHER RESOLVED that a full time, benefitted position of “Administrative Clerk” is created and is assigned to the Administration Department for use as a floating position in various departments as required, utilizing existing budgeted funds for a total annual salary of $23,320.00 plus regular County benefits, and;

BE IT FURTHER RESOLVED that separate, supporting legal documents, contracts and paperwork may be required and that in such event, the Chairman of the Board of Commissioners is authorized to sign and execute any and all documents that substantially support the terms and conditions of this Resolution and authorizes the County Manager or their designee to carry out all terms and conditions of this Resolution and any associated documents lawfully signed, sealed and executed, and;

BE IT FURTHER RESOLVED that the Board of Commissioners reserves the right to terminate all contracts and provisions of this Resolution at their pleasure and will, and;

BE IT FINALLY RESOLVED that the Board authorizes the Chairman of the Board of Commissioners to sign this Resolution on their behalf and authorizes the Clerk of the 123rd Session to attest all signatures and transmit this document to the appropriate entities of Butts County.
