A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY TO PROVIDE CERTAIN SUPPLEMENTAL COMPENSATION FOR THE CORONER OF BUTTS COUNTY; TO DEFINE TERMS OF COMPENSATION; TO AUTHORIZE THE CHAIRMAN OF THE BOARD OF COMMISSIONERS TO SIGN THE RESOLUTION ON BEHALF OF THE BOARD; TO AUTHORIZE THE CLERK OF THE 123RD SESSION TO ATTEST ALL DOCUMENTS AND CAUSE TO BE IMPLEMENTED THE EFFECTS OF THIS RESOLUTION; AND FOR ALL OTHER RELATED AND LAWFUL PURPOSES.

WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia and governed by the Butts County Board of Commissioners, and;

WHEREAS, the Butts County Board of Commissioners, the governing body of the county is charged with ensuring the laws of the State of Georgia regarding Constitutional and Elected Officials are carried out within the political subdivision, including those governing the compensation of said public officials, and;

WHEREAS, the provisions of County Resolution 2019-18, lawfully passed by the Board of Commissioners on June 24th, 2019, contained language whereby “upon the vacating of elected office by any Constitutional Officer or Elected Official ascribed to Butts County…and who is holding office as of July 1, 2019, that any voluntary, non-statutory supplements granted by the Board of Commissioners to these incumbents shall become null and void for their successors in office, other than themselves”, and;

WHEREAS, on January 1, 2021 the incumbent Coroner of Butts County was succeeded by a new Coroner, duly elected by the electors of Butts County and sworn into office as per the requirements of law, thus nullifying any non-statutory compensation provisions that may have previously been ascribed to their predecessor, and;

WHEREAS, the provisions of County Resolution 2019-18, referenced above, require that in order to grant any voluntary, non-statutory supplements to the newly elected Coroner, a separate Resolution, voted upon in an open meeting of the Members of the Board of Commissioners, must first be passed that clearly states the purpose of the supplement and the annual fiscal impact of the supplement on the annual budget, and;

WHEREAS, with the Office of Coroner of Butts County being only a part-time position, the Members are concerned that the compensation afforded by statutory law alone is insufficient to adequately compensate the Coroner of Butts County and therefore wishes to grant a voluntary, non-statutory supplement to the person holding the Office of Coroner of Butts County as of January 1, 2021, now, therefore, be it:

RESOLVED, that the Members hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision, and;

BE IT FURTHER RESOLVED the Commission shall prescribe a salary supplement of $100.00 per payroll, to be paid in 26 equal installments consistent with the payroll cycle of Butts County and which total $2,600.00 per year, to be effective retroactively to the first payroll of calendar year 2021, and to continue until either December 31, 2024 or upon the resignation or removal from office of the Corner, if said event should occur before that date, or if changed by the passage of a Local Act of the Georgia General Assembly prior to said date, and;
BE IT FURTHER RESOLVED that upon conclusion of the 2021-2024 quadrennium, any non-statutory, voluntary supplements granted under the provisions of this Resolution and which have not been diminished or rescinded for reasons other than the expiration of the current term of office, shall terminate and shall not be continued beyond December 31, 2024 unless authorized by the passage of a new resolution, and;

BE IT FINALLY RESOLVED that the Board authorizes the Chairman of the Board of Commissioners to sign this Resolution on their behalf and authorizes the Clerk of the 123rd Session to attest all signatures and transmit this document to the appropriate entities of Butts County.
