A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY TO CLOSE THE HISTORIC BUTTS COUNTY COURTHOUSE AS A JUDICIAL CENTER; TO PAY TRIBUTE TO THE HISTORIC COURTHOUSE FOR TWELVE DECADES OF JUDICIAL SERVICE; TO AUTHORIZE THE CHAIRMAN TO SIGN THE RESOLUTION; TO AUTHORIZE THE CLERK OF BUTTS COUNTY TO ATTEST ALL DOCUMENTS; AND FOR OTHER RELATED AND LAWFUL PURPOSES.

WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia; and

WHEREAS, the Butts County Board of Commissioners is the elected governing body charged with managing the affairs of the County and is the acknowledged owner and holder of all buildings and properties of the Government of Butts County, and;

WHEREAS, in 1897, prominent local Superior Court Judge and later, Georgia Supreme Court Justice Marcus Wayland Beck determined that it was in the best interests of Butts County to construct a new, modern Courthouse to serve the needs of the Citizens of said County, and did under his authority appoint a building committee consisting of five civic-minded local citizens of good standing to study the needs of the Courts, determine costs, acquire an architect of the highest standards and secure a builder of considerable reputation to plan, design and construct the Butts County Courthouse, which was erected and completed in the year of our Lord 1898, and;

WHEREAS, the completed structure has since then faithfully served the Citizens of Butts County, in continuous fashion, as our judicial center for twelve decades and one year, and;

WHEREAS, the Historic Courthouse, far exceeding its anticipated life as a center of justice shall undergo a complete restoration to bring the building up to modern codes and to make it again a pristine example of late 19th century architecture, and;

WHEREAS, provisions are being made to provide a new home for the judicial affairs of Butts County to serve the needs of the Citizens and the Judiciary now and in the future, thus releasing the use of the Historic Courthouse from further judicial responsibilities, now therefore be it:

RESOLVED, that the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision.

BE IT FURTHER RESOLVED the Commission, through this Resolution, does hereby exercise its statutory rights as the Governing Authority of Butts County and the lawful holder of all properties in the public trust for the Citizens of Butts County, and does declare, in accordance with judicial orders to be issued by the Court, that the use of the Historic Butts County Courthouse as a judicial center now shall come to an end, effective September 1, 2019, and;

BE IT FURTHER RESOLVED that the Board wishes to publicly express its unending gratitude and appreciation to the Butts County Courthouse Building Committee, comprised of Judge James F. Carmichael, Chairman, Thomas P. Bell, Obadiah Hendrick, Wilson Smith and Asa H. Smith, for their prudence, knowledge, wisdom and foresight in causing to be built, for the Citizens of Butts County, a courthouse of enduring strength, pride and resilience, which has faithfully served its purpose for one hundred and twenty one years, far beyond their expectations, and;

BE IT FURTHER RESOLVED that the Board publicly express its gratitude to generations of Judges and Court Clerks, Commissioners and County Clerks and many employees of Butts County for their stewardship and care of the building and its records during its entire life, without which this noble structure would not likely have given such long life and fruitful service to its mission, and;

BE IT FURTHER RESOLVED that this Resolution shall be in full force and effect immediately upon its adoption by the Butts County Board of Commissioners and that any and all resolutions or parts of resolutions in conflict with this Resolution shall be, and they, to the extent of such conflict are, hereby repealed, and;

BE IT FINALLY RESOLVED that the Board authorizes the Chairman of the Board of Commissioners to sign this Resolution on their behalf and to authorize the Clerk of Butts County to attest all signatures and spread this resolution upon the minutes of the Board of Commissioners
