A RESOLUTION OF THE BOARD OF COMMISSIONERS OF BUTTS COUNTY APPOINTING A DESIGNATED FINANCE OFFICER FOR BUTTS COUNTY; TO DIRECT THE DESIGNATED FINANCE OFFICER TO REQUEST INFORMATION FROM THE STATE REVENUE COMMISSIONER OF GEORGIA; TO AUTHORIZE THE CHAIRMAN OF THE BOARD OF COMMISSIONERS TO SIGN THE RESOLUTION; TO AUTHORIZE THE CLERK OF BUTTS COUNTY TO ATTEST ALL DOCUMENTS; AND FOR OTHER RELATED AND LAWFUL PURPOSES.

WHEREAS, Butts County is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the state of Georgia, and;

WHEREAS, O.C.G.A. 48-2-15 (d.1) (1) authorizes the Butts County Board of Commissioners to designate a finance officer to receive information included on the vendor’s sales tax certificate for all vendors that have filed a report for the designated period, to be used by such designated officer or official in the discharge of his or her official duties, and;

WHEREAS, O.C.G.A. 48-2-15 (d) (1) authorizes the designated finance officer for a political subdivision to request the State Revenue Commissioner of Georgia to validate the political subdivision to which a taxpayer with a business location within the Butts County political subdivision has remitted sales and use taxes for a designated period, now therefore be it:

RESOLVED by the Board of Commissioners that Chief Financial Officer Rhonda Blissit, 625 W. Third Street, Suite 4, Jackson Georgia 30233, 770-775-8200, rblissit@buttscounty.org is hereby designated as the Finance Officer (the Officer) for Butts County as described in O.C.G.A. 48-2-15 (d.1) (1) and that the Board requests that the State Revenue Commissioner of Georgia furnish unto the above designated finance officer information included on the vendor’s sales tax certificate for all vendors that have filed a report as far back in time as allowed by law, and;

BE IT FURTHER RESOLVED that, upon receipt of this Resolution, the Officer requests from the State Revenue Commissioner of Georgia validation of the political subdivision to which a taxpayer with a business location within Butts County has remitted sales and use taxes as far back in time as allowed by law, and;

BE IT FURTHER RESOLVED that this Resolution and all provisions herein, shall be in full force and effect immediately upon its adoption by the Board of Commissioners and that any and all resolutions or parts of resolutions, in conflict with this Resolution shall be, to the extent of such conflict, hereby repealed, and;

BE IT FURTHER RESOLVED that the Board of Commissioners does hereby authorize the Chairman of the Board of Commissioners to sign this resolution and for said resolution to be attested to by the Clerk of Butts County and disseminated to any required partied by the County Administrator or their designee, and;

BE IT FINALLY RESOLVED that it is the express intention of the Board of Commissioners that each independent provision should be adopted, and that the Board would have adopted each such independent provision even if the others had not been adopted; therefore, in the event that a court of competent jurisdiction finds any of the aforementioned to be unlawful, invalid or unenforceable, that it is the intent of the Board of Commissioners that the offending provision be severed, and that all lawful provisions remain in force.
