A RESOLUTION OF THE BOARD OF COMMISSIONERS TO AUTHORIZE THE UTILIZATION OF A PORTION OF LAKE CLARK ROAD FOR THE CURRENT AND FUTURE DEVELOPMENT OF THE JACKSON TRAIL PROJECT; TO AUTHORIZE THE COUNTY ADMINISTRATOR TO OVERSEE ALL PROCESSES; TO AUTHORIZE THE CHAIRMAN TO SIGN THE RESOLUTION; TO AUTHORIZE THE CLERK OF BUTTS COUNTY TO ATTEST ALL DOCUMENTS; AND FOR OTHER LAWFUL PURPOSES.

WHEREAS, the Board of Commissioners as duly elected representatives of the government of Butts County is the authorized agents in the administration of County properties, including roads under the direct supervision of the County Government, as referenced in O.C.G.A § 32-4-1, which classifies a County Road System as “those public roads within that county, including county roads extending into any municipality within the county, which are shown to be a part of that county road system by the department records on July 1, 1973, and any subsequent additions to such county road system made by the county.” and;

WHEREAS, O.C.G.A. § 32-4-2 and § 32-4-40, requires that each county designate roads that are a part of the county road system and shall maintain an official map of all public roads and a list of same, and;

WHEREAS, O.C.G.A. § 32-4-42 grants each county the right to deal with the administration or operation of any public road or activities incident thereto, and;

WHEREAS, a request has been made by the City of Jackson and the Jackson Trail Committee for a trail currently under development and planning to connect the City of Jackson to Indian Springs State Park, will be required to cross and/or possibly utilize a portion of Lake Clark Road, currently maintained by the County and designated as County Road 298, for the successful completion of this trail, now, therefore be it:

RESOLVED, the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision.

BE IT FURTHER RESOLVED the Commission, through this Resolution, does hereby authorize the proposed future Jackson Trail to, as the need is determined, cross over and/or utilize portions of Lake Clark Road to complete said trail project, with the provision that no actions shall be undertaken that impair or impede the intended function of the road as a mechanism for vehicular and pedestrian conveyance, and;

BE IT FURTHER RESOLVED that the Board authorizes the County Administrator or their designee to oversee all processes of this request, under the advice and counsel of the County Attorney, and;

BE IT FURTHER RESOLVED that the Board authorizes the Chairman of the Board of Commissioners to sign this Resolution on their behalf and to authorize the Clerk of Butts County to attest all signatures and spread this resolution upon the minutes of the Board of Commissioners
