Property Location: St. Marks Church Road (Tax Parcel 0019A-020-000)

Pursuant to O.C.G.A. §36-9-3, the Butts County Board of Commissioners hereby invites sealed bids to purchase real property located on St. Marks Church Road, under the terms and conditions set forth below. The property to be sold has the following legal description:

All that tract or parcel of land lying and being in Land Lot 82 of the 1st Land District, 615th G. M. of Butts County, Georgia, being one (1) acre, more or less, being more particularly designated as Lot No. 18 as per plat made by T.A. Carmichael, dated September 16, 1974. A copy of said plat is recorded at Deed Book 470, Page 131, Butts County, Georgia Records, and is hereby incorporated herein for a more complete and accurate description. This being a portion of the same property as that conveyed in that certain Quitclaim Deed dated September 23, 1978 from Eddie Lawson and Ruby Lawson to Saint Mark United Pentecostal Church of God, Inc., and recorded in Deed Book 69, Page 622, Butts County, Georgia Records, and by Quitclaim Deed dated January 12, 2005 from St. Mark United Pentecostal Church of God to Ruby Lawson and Deborah Watson and recorded at Deed Book 470, Page 130-131, Butts County, Georgia Records. Butts County’s interest in said property was acquired by a Sheriff’s Tax Deed recorded at Deed Book 752, Page 130, Butts County, Georgia Records.

The minimum bid for this property is $2800.00 Butts County will sell the property to the highest bidder provided the minimum bid is met and cash or certified funds are tendered to the Butts County Board of Commissioners within three (3) business days after notice of the award is given to the bidder, failing which the property will be sold to the next highest bidder meeting the minimum bid and payment requirements. Butts County reserves the right to reject any and all bids that do not meet the stated minimum bid or which fail to tender payment as required herein.

All bids must be in writing, sealed in an envelope, and delivered to the County Clerk, 625 West 3rd Street, Jackson, GA 30233 no later than 4:00 p.m. on May 8, 2018. The bid must state the amount the bidder will pay, and the name, address and telephone number of the bidder.

All bids will be opened in public by the County Clerk at 4:15 p.m. on May 8, 2015 at the Offices of the Butts County Board of Commissioners, 625 West 3rd Street, Jackson, GA 30233.
Important Notice of Condition of Sale: The property for sale was obtained by Butts County as the result of a tax sale. More than twelve months have passed since the tax sale and the property has not been redeemed. However, the process to foreclose the right of redemption has not been undertaken by Butts County, and will not be undertaken by Butts County in connection with this sale by bid. Therefore, Butts County makes no warranty as to the marketability of title to the property, and will convey the property to the successful bidder by Quitclaim deed, only. It shall be the responsibility of the successful bidder to take any and all steps necessary to secure good and marketable title to the property under O.C.G.A. §48-4-45 or as otherwise provided by law . The property is sold “AS IS” and Butts County makes no representations or warranties concerning its condition, its suitability for any purpose, or the presence of any encumbrances or encroachments.
