A RESOLUTION OF THE BOARD OF COMMISSIONERS TO REPEAL THE CURRENT VERSION OF THE MERIT SYSTEM OF PERSONNEL POLICIES AND PROCEDURES, HEREINAFTER REFERRED TO AS THE “PERSONNEL ORDINANCE” OF BUTTS COUNTY; TO REAUTHORIZE THE PREVIOUS VERSION OF THE PERSONNEL ORDINANCE WITH RETROACTIVE EFFECT; TO AUTHORIZE THE CHAIRMAN TO SIGN ALL DOCUMENTS; TO PROVIDE FOR THE REIMPLEMENTATION OF THE PREVOUS PERSONNEL ORDINANCE; TO PROVIDE FOR THE COUNTY ADMINISTRATOR TO ADMINISTRATE THE PERSONNEL ORDINANCE AND ALL PROVISIONS THEREUNTO; TO AUTHORIZE THE CLERK TO ATTEST TO ALL DOCUMENTS; TO AUTHORIZE HUMAN RESOURCES TO PUBLISH & DISTRIBUTE THE MATERIALS; AND FOR OTHER LAWFUL PURPOSES.
WHEREAS, OCGA 36-1-21 authorizes the governing authority of any county to provide by ordinance or resolution for the creation of a civil service merit system for employees of the county, other than elected officials or persons appointed to positions for specified terms, and;
WHEREAS, Butts County has established and has operated under a civil service merit system for twenty or more years, with periodical revisions and updates to personnel policies governing said merit system employment, and;
WHEREAS, such civil service system created pursuant to the authority of this Code section shall be administered in such manner and pursuant to such rules and regulations as may be provided for by resolution of the county governing authority which created the system, and;
WHEREAS, the Board of Commissioners passed and authorized the most recent edition of the Personnel Ordinance in March of 2017, with an effective date of July 1, 2017, and;
WHEREAS, it has been determined that significant portions of said Personnel Ordinance are or could be problematic and require significant revisions that call for expeditious action by the Governing Authority to correct, and;
WHEREAS, the County Administrator, as the Chief Administrative Officer of the governing authority shall be charged with the administration of the Personnel Ordinance, either directly or through appropriate subordinate personnel; now therefore be it:
RESOLVED, the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision.
BE IT FURTHER RESOLVED the Commission, through this Resolution, does hereby repeal the 4th edition of the Personnel Ordinance, thus reinstating the previous approved version of the Butts County Merit System of Personnel Policies and Procedures, also known as the “Personnel Ordinance, 3rd Edition”, to be enacted with retroactive effect to July 1, 2017, and grants the Chairman the authority to take any and all further actions necessary to carry out the intents and purposes of this Resolution and authorizes the Clerk of County to attest to all actions and documents pursuant to the provisions of this Resolution and for Human Resources staff to publish said Personnel Ordinance, and;
BE IT FURTHER RESOLVED that the County Administrator is specifically authorized by this Resolution to take all necessary steps to expeditiously implement all provisions of this Resolution, including the ability to make whole any unresolved issues that may be carried over from any previous editions of the Personnel Ordinance, within the boundaries of the law and County ordinances, and to henceforth administrate or cause to be administrated, the Personnel Ordinance of Butts County in a fair and judicious manner, and;
BE IT FURTHER RESOLVED that except as specifically provided herein, any and all resolutions, policies or procedures or parts of resolutions, policies or procedures in conflict with this Resolution or the provisions provided therein shall be and the same hereby are repealed, and this Resolution shall be in full force and effect from and after its adoption by the Board of Commissioners, and upon the signature of the Chairman and attestation by the Clerk, as authorized in this Resolution.
